9:15-10:30 a.m. Sailing Through the Interactive Process: Navigating the Treacherous Waters of Workers’ Compensation, ADA, Retirement, and FEHA.

Presenters will cover the overlapping subject areas pertaining to returning an employee to work after a workers’ compensation related period of absence including how to identify and handle work restrictions, competing restrictions from the PTP and or QME, conflicting industrial vs. non- industrial reports, making return to work offers (SJDB/vouchers), the potential exposure for disability discrimination under AD and FEHA requirements including the disclosure and use of HIPAA protected information, the Interactive Process, and correlation with Industrial Disability Retirement.

In response to the "Me-Two" Movement, California legislators have passed significant new legislation that will be in effect as of January 1, 2019. Employers must understand these new laws to ensure compliance and to help create a workplace free from unlawful discrimination, harassment and retaliation. Ms. O'Brien will also cover employer best practices for compliance and for educating management and employees about the required policies.
