We have learned that being proactive before and immediately after any such fatal incidents oftentimes leads to minimizing (or eliminating) the financial risk to the public entity and its employees. The proactive approaches include handling post-incident proceedings (inquests, criminal and administrative investigations) following a fatal incident, handling the media and public record requests, monitoring and focusing the investigation(s), using experts and the right experts for evaluative and defensive purposes, anticipating and preparing for inevitable issues whether it relates to negligence or constitutional claims, especially in light of the Hayes v. City of San Diego case from the California Supreme Court (2013), as adopted by the Ninth Circuit, and other insights to assist you in defending such matters and limiting municipal exposure.
